Naughty WIN Tas- broadcasting unlicenced?

I was reading the fine print of the ABA documents released last month and noticed that WIN were actually broadcasting a repeater service on UHF 60 without a licence from the ABA:

After the release of the draft variation to the Tasmania DCPs – March 2003, the ACA advised the ABA that channel 60, which was proposed for allotment and assignment to the SBS, was currently being used by TVT for an analog service at Hobart NE Suburbs, albeit unlicensed.

Following advice from WIN, the ABA licensed two previously unlicensed WIN services at Hobart NE Suburbs and New Norfolk. As discussed under “Assessment of Available Channels”, this required a change to the allotments and assignments at Hobart NE Suburbs.

I thought they could have got in all sorts of trouble for doing something like that! Looks like they got away with a slap on the wrists? Nobody had made any mention of this in the forums previously, I think the 16:9 discussion was distracting!  :blink:
